The case, recently heard in Matero Local Court, paints a disturbing picture of a relationship marred by alleged violence and a profound lack of respect. What began as a seemingly harmonious union quickly descended into a cycle of conflict and recrimination, ultimately leading to its dissolution.

Cletus Sambondu, the 44-year-old plaintiff, claimed his now ex-wife, Anna Tembo, 35, subjected him to repeated physical assaults and verbal abuse. He alleged that Anna frequently belittled his manhood, often making disparaging remarks in front of their children. These public humiliations, he argued, created an unbearable environment and eroded any semblance of marital harmony.

According to Cletus, the problems started escalating roughly a year after their 2022 wedding. He testified that Anna began denying him intimacy, resorting to insults and physical violence whenever he initiated contact. Despite attempts by family members to mediate and reconcile the couple, the situation only worsened, culminating in Cletus reporting the alleged abuse to the police.

Anna, however, presented a different narrative to the court. She admitted to slapping Cletus and withholding intimacy, but claimed her actions were a response to his behavior. She accused him of repeatedly watching adult content and engaging in self-gratification, actions she deemed disrespectful to their marriage. She also described Cletus as a heavy drinker who frequently neglected his work responsibilities, sometimes staying away for months at a time.
Despite Anna’s expressed desire to salvage the marriage, Magistrate Harriet Mulenga concluded that the relationship was irreparably broken due to the pervasive lack of mutual respect. The court was particularly swayed by an audio recording of Anna verbally abusing Cletus. The magistrate emphasized that mutual respect is a fundamental pillar of a successful marriage.
Ultimately, the court granted the divorce, acknowledging the irretrievable breakdown of the marital union. The court ordered Cletus to provide monthly maintenance payments for their young child. The couple’s shared household property will be divided equally, and no compensation was awarded to either party, marking the end of their four-year marriage.
